Your viewing or use of these web sites will constitute your agreement, on behalf of yourself and the entity you represent, as well as your successors, assigns, family members and heirs (collectively "you" or "your"), to all of the terms and conditions provided herein  (the "agreement"). Natural expectations may make future changes or modifications to this agreement at any time without notice and your subsequent viewing or use of natural expectations web site will constitute your agreement to the changes and modifications. There may be additional terms and conditions governing your use of particular functions, features, information and applications available through the natural expectations web site. In the case of any violation of this agreement, natural expectations reserves the right to seek all remedies available at law and in equity for such violations. This agreement applies to each and every visit to the natural expectations web site.

Section 1. Use.

The Natural Expectations^SM Web Site is provided solely for the use of current and potential photographer partners and individual clients.  Natural Expectations^SM does not accept ideas, concepts, or techniques for new services or products through the Natural Expectations^SM Web Site. If we receive such information, it will not be considered confidential and Natural Expectations^SM will be deemed free to utilize such information in any manner it chooses. To the extent possible to post, you agree not to post on the Natural Expectations^SM Web Site any content which (a) is libelous, defamatory, obscene, pornographic, abusive, harassing, or threatening, (b) contains viruses, worms, or other contaminating or destructive features, (c) violates the rights of others, including protections of copyright, trademark, patent, trade secrets or any right of privacy or publicity, or (d) otherwise violates any applicable law. You will not post on the Natural Expectations^SM Web Site any links to any external Internet sites that are obscene or pornographic. Any information that you provide to Natural Expectations^SM must be true, complete and accurate, must not be misleading as to your identity, or falsely identify any third party, and must not violate any law, statute, ordinance or regulation.

Section 2. User Name and Password.

By registering with Natural Expectations^SM, you may be provided with a User Name and Password. You are responsible for maintaining the confidentiality of the Password and User Name, and you are responsible for all activities that occur under your Password and User Name. You agree to (a) immediately notify Natural Expectations^SM of any unauthorized use of your User Name and Password, and (b) ensure that you exit (Log Out) from your Natural Expectations^SM Web Site session at the end of each visit.

Section 3. Changes to Natural Expectations^SM Web Site.

The Natural Expectations^SM Web Site and its content, including without limitation the information, graphics, products, features, functionality, services, and links (collectively the "Content") may be changed, deleted or updated by Natural Expectations^SM without any prior or post notice.

Section 4. Term.

Natural Expectations^SM may discontinue, suspend or modify the Natural Expectations^SM Web Site  at any time without notice, and Natural Expectations^SM may block, terminate or suspend your and any user's access to the Natural Expectations^SM Web Site at any time for any reason in its sole discretion, even if access continues to be allowed to others.

As part of the services and content you will find on the Natural Expectations^SM Web Site, Natural Expectations^SM, or a third party, may provide links to other Internet content, sites, services, or resources.  You agree and acknowledge (i) Natural Expectations^SM has no editorial control over such content, sites, services, or resources, (ii) Natural Expectations^SM is not responsible for the availability of such external content, sites, services, or resources, and (iii) such links are not express or implied endorsements or approvals by Natural Expectations^SM of any such content, sites, services, or resources.  Further, you agree and acknowledge the Natural Expectations^SM is not, and will not be liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with use of or reliance on any such content, sites, services, or resources.

Your correspondence or business dealings with, or participation in promotions of, any third party found on or through the use of the Natural Expectations^SM Web Site, including, without limitation, payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third party.  You agree and acknowledge that Natural Expectations^SM is not, and will not be, responsible or liable for any loss or damage of any sort incurred as a result of any such dealings, and you promise to waive and release any claims or causes you may have against Natural Expectations^SM, as well as indemnify, defend, and hold Natural Expectations^SM harmless from any liability asserted against Natural Expectations^SM by a third party as a result of any such dealings.

Section 8. Indemnity.

You hereby release, and agree to indemnify, defend and hold harmless Natural Expectations^SM, its affiliates, subsidiaries and their respective officers, directors, managers, partners, members, shareholders, employees and agents from any and all losses, claims, demands, causes of actions, liabilities, damages, costs and expenses, including reasonable attorneys' fees, arising out of your use, misuse or viewing of the Natural Expectations^SM Web Site and its content.

Section 9. Copyright/Restrictions on Use of Material.

Data mining, screen scraping, downloading or any other activity designed to obtain, re-use, reformat, or re-sell the proprietary or other information contained within the Natural Expectations^SM Web Site is strictly prohibited. Natural Expectations^SM reserves the right to immediately terminate your account if it determines that the Natural Expectations^SM Web Site is being used for such activity. The reposting, manipulation, display or other web-based presentation of data obtained through the Natural Expectations^SM Web Site (the "Prohibited Activities") on the Internet or through e-mail is strictly prohibited and may constitute copyright, trademark or service mark infringement. In the event that Natural Expectations^SM determines that you are engaged in any Prohibited Activities, Natural Expectations^SM will seek injunctive relief in any court located in Dallas, Texas and you, through the use of the Natural Expectations^SM Web Site, consent to the court’s jurisdiction and shall be liable for all attorneys’ fees incurred by Natural Expectations^SM while enforcing its right to injunctive relief and any other relief sought by Natural Expectations^SM related to your Prohibited Activities or any other wrongful action referenced herein.

Section 10. Trademarks, Service Marks, Logos, Corporate Identifications.

All trademarks, service marks, logos, or other corporate identifications (collectively, "Marks") on the Natural Expectations^SM Web Site are trademarks or service marks of Natural Expectations^SM. You agree not to use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Marks in any way. The use of these Marks on or as a link to any other Web Site is strictly prohibited without prior written approval by Natural Expectations^SM.

Section 11. Export.

You assume all responsibility for compliance with all laws and regulations of the United States and any other country from which you may access the Natural Expectations^SM Web Site regarding access, use, export and import of any Content appearing on or available through the Natural Expectations^SM Web Site. You acknowledge and agree that you will not export or import any Content to any country wherein export or import is restricted under United States law and that you are not a national of any such country.

Section 12. Controlling Law and Severability.

This Agreement and your use of the Natural Expectations^SM Web Site is governed by and construed in accordance with the laws of the United States and the State of Texas. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or a portion thereof, to be unenforceable, void, voidable, or of no force and effect, no other portion will be thereby affected, and the remainder of this Agreement will continue in full force and effect.  This Agreement is performable by you in Dallas County, Texas and jurisdiction and venue for any  cause of action arising under  this Agreement or your use of the Natural Expectations^SM Web Site shall be in Dallas County, Texas. This Agreement may not be changed or modified without the written consent of Natural Expectations^SM.

Section 13. Waiver.

No delay of Natural Expectations^SM in exercising any power or right under this Agreement shall operate as a waiver thereof; nor shall any single or partial exercise of any power or right preclude other or further exercise thereof or the exercise of any other power or right.  No waiver by Natural Expectations^SM of any right hereunder or of any default by you shall be binding upon Natural Expectations^SM unless in writing, and no failure by Natural Expectations^SM to exercise any power or right hereunder or waiver of any default by you shall operate as a waiver of any other or further exercise of such right or power or of any further default.

Section 14. Personal Information.

We know that you care how your information is used, and we appreciate your trust that we will use it carefully and sensibly. This notice describes our privacy policy. By visiting us, you are accepting this privacy policy. We receive and store information you enter.  You can choose not to provide certain information, but then you might not be able to take advantage of some of our features.  We use the information that you provide for such purposes as responding to your requests and for providing you with the goods and services requested.  We will not sell or share the personal information you submit, with the exception of certain personal information to be used by Natural Expectations^SM.  Natural Expectations^SM will endeavor to obtain your prior consent before using photographs of you, but Natural Expectations^SM does reserve the right to use photographs of you in such a manner to show the results of the medical services provided for you, as well as testimonials from you. Every computer has an IP (Internet Protocol) address.  IP addresses of computers used to visit this site may be noted.  In addition, we may collect other information such as email addresses, browser types, operating systems, and the URL addresses of sites clicked to and from this site. We might receive information about you from other sources and add it to our account information.  This may include updated delivery and address information so that we can correct our records and deliver your next purchase or communication more easily.  We use your information to better serve you by providing a customized shopping experience.

Natural Expectations^SM will do its best to protect the security of your personal information, but absolute security and privacy cannot be guaranteed or assured.  As a result, you agree to waive any claims against and hold Natural Expectations^SM harmless from any such damages you may suffer as a result, as provided hereinabove.  No system can guarantee absolute security, just as the finest lock can not guarantee physical security.  However, we take every reasonable precaution to assure that your data is secure. It is your choice whether to receive emails or special offers from us or others, and Natural Expectations^SM will be reasonable efforts to honor your request.
